2018 Lenczner Slaght/CLA Gale Cup Moot Takes Place February 16-17
Lenczner Slaght is pleased to announce that the Criminal Lawyers’ Association (“CLA”) will be the new co-sponsor of the Gale Cup, replacing the Canadian Bar Association. The CLA is Canada’s largest criminal law specialty association and a leading voice for criminal justice and civil liberties in Canada.
The Lenczner Slaght/CLA Gale Cup Moot, one of Canada’s most prestigious bilingual law school mooting competitions, takes place February 16-17 at Osgoode Hall in Toronto, with 16 law schools from across Canada participating.
The competition will open with a special welcome reception in the lobby of Lenczner Slaght’s offices on Friday, February 16. “The Gale Cup offers young advocates the chance to test their skills at the beginning of their careers, “ said Tom Curry, managing partner of Lenczner Slaght. “We are very excited to know that our sponsorship is supporting the development of tomorrow’s great lawyers.”

In addition to the Gale Cup and other team and individual awards, the McLachlin Prize will be awarded to the best female mooter on Saturday, February 17 at Osgoode Hall. The Honourable Justice Suzanne Côté of the Supreme Court of Canada will deliver the after-dinner keynote address at the gala awards banquet.
This year’s case is R v Paterson. In R v Paterson, 2017 SCC 15, a 911 call led RCMP officers to the door of Brendan Paterson, where the smell of marijuana prompted them to search his home despite finding insufficient urgency or cause to arrest him. Police found drug paraphernalia, a bullet proof vest and a number of firearms, but the Supreme Court of Canada overturned his convictions in 5-2 decision clarifying the requirements for exigent circumstances in police searches of suspects’ homes. In acquitting Mr. Paterson, the Court further found that considerations of voluntariness and the common law confessions have no operation during a Charter voir dire to ascertain the admissibility of evidence at trial. The dissenting Justices agreed with the Majority on the substantive points of law, but would have allowed the evidence seized from Mr. Paterson's home due to the good faith conduct of police in what they considered a legal grey area.
Students taking part in the Lenczner Slaght/CLA Gale Cup Moot are permitted to moot in either English or French, with simultaneous translation provided for oral arguments.
