Mariam Moktar
Mariam maintains a varied civil litigation practice, focusing on professional liability and regulation, employment litigation, commercial litigation, administrative law and class actions. She has appeared at all levels of court in Ontario, the Federal Court as well as various administrative boards and tribunals.
During her articling year, Mariam worked closely on a high profile case concerning a senior politician at the Superior Court of Justice. She then clerked for various judges of the Superior Court of Justice in the Central West Region, and served judges of the Divisional Court where she gained a broad experience in civil, criminal, family and administrative law. Mariam went on to practice at another leading Canadian law firm, focusing on employment law, human rights and administrative law.
Mariam now represents a breadth of clients, from physicians and working professionals to corporations. She understands the importance of knowing clients and their unique legal needs, and she provides the practical advice needed to solve their problems.

The Association of Justices of the Peace of Ontario v Ontario
Counsel to the AJPO in a successful application for judicial review of the Ontario government's response to a judicial remuneration commission. An interim order was obtained that stayed the implementation of certain changes to the benefits of the Justices of the Peace of Ontario pending the hearing of the application.

Active Employment Clause Not Enough: Common Law Right to Damages Must be Ousted
An “active employment” clause in a bonus plan is not sufficient to extinguish an employee’s right to damages for lost bonuses in a wrongful dismissal action. This principle was affirmed by the Ontario Court of Appeal in the recent decision of Paquette v TeraGo Networks Inc.
