“The Supreme Court (of Canada) has very recently expanded the circumstances where people could say ‘we were in an unequal bargaining position and the contract’s not fair,'” said Rebecca Jones, a Toronto lawyer whose specializations include professional liability.

“If you have those two things, (the court) might say we can’t enforce it.”
