York University Succeeds in Fraud Claim Against Former Executive

Following a lengthy trial, the Ontario Superior Court of Justice has determined that former York employees played key roles in several significant frauds.

Will McDowell, Nadia Campion and Brian Kolenda of Lenczner Slaght acted as counsel to York University in the successful trial of a fraud action against a former York executive and a key subordinate.

The Court awarded York significant damages for fraud and breach of fiduciary duty. It also set aside a severance agreement with one of the two executives and the fraudulent conveyance of two of his homes. The decision will be of interest to organizations who seek to recover funds from former employees who are later discovered to have committed wrongdoing while employed.
