Grace Tsakas (she/her)
is a law clerk at Lenczner Slaght.
Grace has almost three decades of experience in various areas of law, including civil, commercial, insurance and securities litigation, as well as corporate and public policy. She has also assisted in the preparation of applications and regulatory filings to various administrative tribunals. She has been involved in many high profile, complex commercial litigation matters and class actions requiring intensive management of information and documentation. She provides lawyers with support throughout the entire litigation process, from initial meeting and fact investigation, to examination for discovery, mediation, arbitration and trial preparation and attendance, including providing support as an action moves to the Court of Appeal and Supreme Court of Canada. In addition, she is also involved with the enforcement of judgments.
Grace is results oriented and assisted with creating the firm’s protocols intended to ensure consistency in processes, which in turn simplifies the management of actions. She is proficient in electronic document management and provides the firm with eDiscovery project management and support that generates solutions within various platforms, including Ipro Eclipse and Ipro Eclipse SE, Summation, Relativity and Clearwell.
Grace is fluent in Spanish.

Castillo v Xela Enterprises Ltd
Counsel to the court-appointed receiver in contempt proceedings on the Commercial List. Successfully obtained a finding of civil contempt and a full indemnity costs award – both of which were upheld on appeal.

Mel Pearl Construction Limited et al v Cubert Inc
Counsel to a commercial landlord in an action for breach of contract arising from the default of a commercial lease agreement. Successful in obtaining a $2 million default judgment.

Annapolis Group v Halifax Regional Municipality
Counsel to the plaintiff in an action concerning alleged de facto expropriation, misfeasance in public office, and unjust enrichment relating to the plaintiff’s efforts to develop its lands within the Halifax Regional Municipality. Successfully represented the plaintiff at the Supreme Court of Canada with the Court clarifying the test for de facto expropriation and concluding that our client’s claim for de facto expropriation could proceed to trial.

Counsel to the Law Society of Ontario in an application to have a trustee appointed over a Lawyer’s mortgage administration practice.

Cappelli v Nobilis Health Corp
Counsel to the successful defendant in resisting a motion for leave to pursue a claim or secondary market misrepresentation under the Ontario Securities Act and certification of a class action under the Class Proceedings Act, 1992.

Manga Hotels (Toronto) Inc v GE Canada Equipment Financing GP
Counsel to GE Canada Equipment Financing GP in a dispute relating to the financing of a hotel construction project.

Counsel to Atos in a dispute respecting the termination of a subcontract for data conversion and software support. The matter was subject to numerous motions and proceeded to a five week trial before the Ontario Superior Court of Justice, where Atos was successful in recovering approximately $5.5 million in damages.

Commissioner of Competition v Rogers Communications Inc
Counsel to the Commissioner of Competition in proceedings against Rogers Communications Inc. and Chatr Wireless Inc. relating to misleading advertising under the Deceptive Marketing Practices provisions of the Competition Act. The application involved successful defence to a constitutional challenge to certain provisions of the Competition Act brought by the respondents.

Yaiguaje v Chevron Corporation
Counsel for the Ecuadorian plaintiffs in a Canadian action for an order recognizing a $9.51 billion (USD) Judgment obtained in Ecuador against Chevron Corporation regarding oil pollution in the Amazon. Successful respondents in an appeal to the Supreme Court of Canada of the jurisdictional challenge of the action for recognition and enforcement.
